Terms of Service

Welcome to DoctorEscribe. These Terms of Service govern access to and use of our medical transcription platform powered by artificial intelligence. By registering for or using DoctorEscribe, you represent that you have read, understood, and accepted these terms in their entirety. If you do not agree with any of the conditions set forth herein, we ask that you not use the service.

1. Acceptance of the Terms

By accessing DoctorEscribe, whether through our web application or any other interface we make available, you enter into a binding agreement with DoctorEscribe (hereinafter, "the Company", "we", or "our"). This agreement includes these Terms of Service, our Privacy Policy, and any additional agreements that may apply to specific features of the service.

If you access the service on behalf of an organization (clinic, hospital, medical group), you represent that you have the legal authority to bind that organization to these terms, and the terms "you" and "your" shall refer both to you and to that organization.

The minimum age to use DoctorEscribe is 18 years. By accepting these terms, you confirm that you meet this requirement.

2. Description of the Service

DoctorEscribe is a software-as-a-service (SaaS) platform designed exclusively for healthcare professionals. Our core service consists of:

Automated medical transcription: Conversion of audio from medical consultations into structured text using speech recognition models specialized in clinical terminology in English and Filipino.

Clinical note generation: Automatic creation of structured medical notes (SOAP format, progress notes, discharge summaries, medical orders, among others) from the generated transcriptions.

Patient management: Tools to organize and access each patient's clinical note history efficiently and securely.

Customizable templates: A library of clinical templates adaptable to different medical specialties and user preferences.

DoctorEscribe is a clinical documentation support tool. It does not replace the professional judgment of the physician, does not constitute a diagnostic system, and must not be used as the sole resource for clinical decision-making.

3. Requirements for Use

To use DoctorEscribe, you must meet the following requirements:

Professionalism: DoctorEscribe is designed exclusively for licensed healthcare professionals with a current license (physicians, nurses, psychologists, dentists, physical therapists, and other authorized clinical professionals). Use by individuals without a professional degree or license is prohibited.

Active license: You must hold a current professional license or registration in your country of practice. DoctorEscribe reserves the right to request credential verification at any time.

Legitimate use: You must use the service solely for legitimate clinical purposes related to your professional practice. Use of the service for any illegal or fraudulent activity, or one that violates the rights of third parties, is prohibited.

Adequate equipment: It is your responsibility to have the equipment, internet connection, and environment appropriate for the safe use of the service, including ensuring confidentiality during consultation recordings.

4. User Account

Registration: To access DoctorEscribe you must create a personal account with truthful, complete, and up-to-date information. You are responsible for keeping your account information current.

Confidentiality: It is your responsibility to maintain the confidentiality of your access credentials. You must not share your password or allow third parties to access your account. Any activity carried out from your account is your responsibility, unless you notify DoctorEscribe of unauthorized access immediately.

Multiple accounts: Creating multiple accounts to circumvent restrictions, obtain prolonged free access, or for any other fraudulent purpose is not permitted. Each healthcare professional must have a single personal account.

Security: If you suspect that your account has been compromised, you must notify us immediately at soporte@doctorescribe.com. DoctorEscribe will not be liable for losses caused by the unauthorized use of your account if you did not notify us in a timely manner.

Cancellation: You may cancel your account at any time from your profile settings. For paid accounts, cancellation takes effect at the end of the current billing period.

5. Medical Data and Privacy

Data ownership: The clinical data that you enter or generate in DoctorEscribe is your exclusive property. DoctorEscribe claims no ownership rights over the clinical notes, transcriptions, or patient information stored in your account.

Responsibility for consent: You are solely responsible for obtaining the informed consent of your patients before recording or processing their medical information through DoctorEscribe. This consent must comply with the applicable legislation in your jurisdiction. DoctorEscribe provides guideline templates but assumes no responsibility for compliance with this obligation.

Data processing: By using the service, you authorize DoctorEscribe to process the medical data you enter or generate solely for the purposes described in the Privacy Policy. We will not use your clinical data to train artificial intelligence models without your explicit and separate consent.

Confidentiality: DoctorEscribe is committed to maintaining the confidentiality of all clinical data in accordance with our Privacy Policy and the applicable standards for health information security.

6. Acceptable Use

When using DoctorEscribe, you agree not to engage in the following activities:

Prohibited uses: Using the service for any illegal or unauthorized purpose; attempting to access other users' data; reverse engineering, decompiling, or disassembling the software; using bots, scrapers, or automated tools to access the service in an unauthorized manner; deliberately overloading the service's infrastructure; impersonating another person or entity.

Prohibited content: Uploading, transmitting, or storing content that infringes the intellectual property rights of third parties; content that promotes illegal activities; malware, viruses, or any malicious code; false or fabricated information presented as real clinical data.

Commercial use restrictions: Reselling, sublicensing, or commercializing access to the DoctorEscribe service without the prior written authorization of the Company is not permitted.

Failure to comply with these rules may result in the immediate suspension or cancellation of your account, as well as legal action where applicable.

7. Intellectual Property

DoctorEscribe ownership: The DoctorEscribe platform, including its source code, design, user interface, brand, logos, artificial intelligence models, algorithms, and documentation, are the exclusive property of the Company and are protected by the applicable intellectual property laws. No provision of these Terms grants you any rights over such intellectual property.

License to use: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use DoctorEscribe exclusively for your personal clinical purposes or those of your organization, in accordance with these Terms.

User content: You retain all rights to the content you create on the platform (clinical notes, custom templates). However, you grant us a limited license to process such content for the sole purpose of providing the service described.

Feedback: If you provide us with suggestions, ideas, or feedback about the service, we may use them without restriction and without any obligation of compensation.

8. Limitation of Liability

Support tool: DoctorEscribe is a clinical documentation support tool. The notes and transcriptions generated by our artificial intelligence may contain errors and must be reviewed and validated by the healthcare professional before being incorporated into the patient's official clinical record. The clinical and legal responsibility for medical decisions rests exclusively with the healthcare professional.

Limit of liability: To the maximum extent permitted by applicable law, DoctorEscribe will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, business interruption, or any other intangible damage, arising from the use of or inability to use the service.

Maximum liability: DoctorEscribe's total liability to you for any claim related to the service shall not exceed the total amount you have paid to DoctorEscribe during the 12 months prior to the event giving rise to the claim.

Indemnification: You agree to indemnify and hold DoctorEscribe, its directors, employees, and agents harmless against any claim, damage, cost, or expense (including reasonable legal fees) arising from your use of the service in violation of these Terms.

9. Service Availability

Service level: We strive to keep DoctorEscribe available 24 hours a day, 7 days a week. However, we do not guarantee a specific level of availability nor that the service will be free of interruptions or errors.

Maintenance: We may perform scheduled maintenance that causes temporary service interruptions. To the extent possible, we will provide advance notice of significant scheduled maintenance through the platform or by email.

Force majeure: DoctorEscribe will not be liable for service interruptions caused by factors beyond its reasonable control, including third-party infrastructure failures, natural disasters, internet connectivity problems, or governmental acts.

Modifications to the service: We reserve the right to modify, suspend, or discontinue any feature of the service at any time, with or without prior notice, although we will make our best effort to notify you in advance in the event of significant changes.

10. Modifications to the Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will notify you through the platform and by email at least 30 days before the changes take effect.

If you continue to use DoctorEscribe after the effective date of the changes, you will be deemed to have accepted the new terms. If you do not agree with the modified terms, you must stop using the service and cancel your account before the effective date.

The most recent version of these Terms will always be available on this page, with the last updated date clearly indicated.
